Amendments to Reservation Contract

1) The definition of Exclusivity Period in the Reservation Contract shall be amended so that it reads as follows: "The period of forty (40) business days (or such other period stated in the RESERVATION CONDITIONS) during which the BUYER has the exclusive right to buy the LOT"

This means that the buyer and seller shall have 40 business days to exchange from the end of this auction.

2) The Buyer and Seller agree that Clause R6.5 and R6.6 of the Reservation Contract shall be removed and shall not apply in relation to this Property. For the avoidance of doubt, the Buyer agrees that the Reservation Fee shall be non-refundable in all circumstances.

3) The Buyer and Seller agree that where a consent is required from the managing agents of the Property (where relevant), and such consent has not been provided by the managing agents within the Exclusivity Period (as amended above), the Exclusivity Period shall automatically extend by a further 40 business days (the Extension).

Conditional auction

If the reserve is met or exceeded and the auction timer reaches zero, an exclusivity period begins in relation to that property. The successful bidder is contractually required to exchange on the property on or before the expiry of 20 working days from the end of the auction. To ensure that the successful bidder proceeds, the buyer is automatically charged a holding deposit, which is held in a secure client account, pursuant to the terms of the reservation agreement, which is produced at the end of the auction. The auctioneer will be authorised to sign the reservation agreement on both the buyer’s and seller’s behalf. If by the seller’s act, exchange does not occur on or before the expiry of 20 working days from the end of the auction, the holding deposit shall be fully refunded to the buyer.
